Terms of Service

1. Acceptance of Terms

By enrolling in the WorkXP Program ("Program"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not enroll in the Program.

2. Program Description

WorkXP provides a paid work experience program for international students in Australia. The Program includes:

  • Placement with Australian employers
  • Professional mentorship and training
  • Assistance with employment contracts
  • Career coaching and development
  • Visa pathway consultation (not migration advice)

3. Eligibility Requirements

To participate in the Program, you must:

  • Be an international student with valid work rights in Australia
  • Maintain valid visa status throughout the Program
  • Be enrolled in or have completed a degree program
  • Meet minimum English language requirements
  • Pass our screening and assessment process

4. Program Fees and Payment

4.1 Monthly Investment: The Program fee is AU$3,000 per month, payable in advance.

4.2 Payment Methods: We accept bank transfers, credit cards, and other approved payment methods.

4.3 Late Payments: Late payments may result in suspension or termination from the Program.

5. Placement Guarantee

5.1 Placement Commitment: We guarantee placement with an employer within 30 days of enrollment, subject to:

  • Your continued eligibility and visa status
  • Your active participation in the placement process
  • Your acceptance of reasonable placement offers
  • Completion of required assessments and training

5.2 Salary Expectations: While we target minimum earnings of AU$2,000 per month, actual wages depend on employer agreements and hours worked.

6. Participant Obligations

As a Program participant, you agree to:

  • Maintain professional conduct at all times
  • Comply with employer requirements and Australian workplace laws
  • Attend scheduled work shifts and training sessions
  • Communicate promptly about any issues or concerns
  • Complete Program requirements and assessments
  • Maintain valid work rights throughout the Program

7. Refund Policy

Please refer to our separate Refund Policy for detailed information about refunds and cancellations.

8. Intellectual Property

All Program materials, including training content, assessments, and resources, remain the intellectual property of WorkXP. You may not reproduce, distribute, or share these materials without written permission.

9. Confidentiality

You agree to maintain confidentiality regarding proprietary information about WorkXP, our partner employers, and other Program participants.

10. Disclaimer and Limitations

10.1 No Migration Advice: WorkXP does not provide migration advice. Visa-related information is general in nature. Consult a registered migration agent for specific advice.

10.2 No Employment Guarantee: While we guarantee placement efforts, we cannot guarantee specific employment outcomes, visa points, or career progression.

10.3 Limitation of Liability: Our liability is limited to the fees paid for the Program. We are not liable for indirect, consequential, or incidental damages.

11. Termination

11.1 By You: You may terminate participation with 30 days written notice, subject to our Refund Policy.

11.2 By WorkXP: We may terminate your participation for:

  • Breach of these Terms
  • Non-payment of fees
  • Misconduct or unprofessional behavior
  • Loss of visa or work rights
  • Failure to meet Program requirements

12. Dispute Resolution

Any disputes will first be addressed through good faith negotiation. If unresolved, disputes will be subject to mediation in accordance with Australian law.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You consent to the exclusive jurisdiction of New South Wales courts.

14. Changes to Terms

We may update these Terms with 30 days notice. Continued participation constitutes acceptance of updated Terms.
